I used to be an admin of mazdaspeed 3 owners group on facebook. I am no longer, but that's a different story for another day. Well one of the members was asking about clutch and flywheel options. I told them that I just bought a Luk clutch kit off of amazon for $181 and a Fidanza Flywheel from Edge autosport for $335 all shipped for free and how this was the best deal. Well XTR nate is an admin at mazdaspeed owners group on facebook (confusing as fuck I know) and a few minutes later I received these PM's from him on facebook Attachment 155913Attachment 155914Attachment 155915Attachment 155916Attachment 155917Attachment 155918Attachment 155919Attachment 155920 So I pretty much let this slide although now I am convinced this guy is a douche but whatever. The straw that broke the camels back was what he did today. He posts this on his facebook page. Attachment 155921Attachment 155922 yes that's right. He used a picture of Rob Finkles car who has no affiliation with XTR Nate or XTR performance, taken by a professional photographer, who did not give permission to XTR nate or XTR performance in order to boost their sales. And the worst thing is , they see nothing wrong with it. They think rob should feel honored that they are giving him publicity. So a long argument ensues with some of his nut swinging dick riding fans and then I get banned. I then decide to let XTR performance know about nates actions. Those cunts lost any respect from me when they tried to get some stance loving kid trolled because the kid asked BC to beat the quote XTR gave, which ended up being below the Manufacturer's Authorized Price. They then posted the email from BC telling em that since it was the 2nd offense, their rate to buy from BC is going up. Yes he was. He said he didn't mind as long as it didn't get out of hand. I know rob can stand up for himself but I dont like many of their shady sales tactics and this just hit home to one of my buddies. That photographer is getting his work stolen from him. I really appreciate Rich's thoughts more than anything. Mike Neary (Mike@stratified) was the photographer and probably has a better handle on what should / can't be used as advertisement, and even more importantly, if he wants his photos pimped as an advertisement. If I was asked before someone wanted to use an image of my car, I usually would say sure, but in this case, it is kinda wacky that Nate used it without just quickly pming me first. |

When I was looking for rods, pistons, v3 and some other crap I had a local buddy recommend XTR Nate. I sent him a PM on Facebook and his responses just kinda threw me. I had to ask and ask and ask for details. His first response was with a generic $xxxx price and after going back and forth a few times I FINALLY got the information of the rods and pistons he was trying to sell me. I was pissed that I had to "dig" for that information. Later that day I logged onto edge's site and proceeded to place my ~$2,700 order. |

It's a not very cleverly masked sales group - there's half decent conversation at times, but whenever parts are brought up, you can count on a sales pitch. I get that people need to get their name out there to make a living, but it turns a social media outlet into an Amway convention. I would unsubscribe, but cartwheels is ball sacks and people taking a dump, so I have to combine them like the wonder twins for palatable sort-of-Mazda entertainment. |

That'd be DMCA'd. It's pretty unlikely that the photo would be. Of course, it doesn't matter even if he did. The photo was copyrighted (even though it may not have been registered with the Copyright office), the moment it was "fixed in a tangible medium of expression." That is, the moment the photo was saved to a disk or posted on a website, or anything of the sort, it became copyright-protected. If you're interested, and want WAAAAY too much technical information, here's a good resource: U.S. Copyright Office - Copyright Law of the United States I'm pretty sure that the copyright-owner (Mike?) could file a DMCA complaint, and demand that the photo be taken down. There's a set process for this sort of thing, but it's a little harder when the ne'er-do-well company is a relatively small outfit, as they aren't held to quite the same standards as, say, Youtube. |
Has the copyright holder asked him to take it down? I think that would be the first step. Clearly he posted the picture without permission, which was wrong on his part, but if the proper credit is given and the copyright holder is OK with it now, then that half of the problem is solved. ;) |

I have messaged Nate about the use of my work. I told him that he should have asked permission in all three instances (that I know of) where he used the photo. I also told him that he may NOT use the photo for sale purposes without my permission and further agreement. His original use of the photo with "PM me for pricing" was not cool and he has now changed it to something that is acceptable to me. I have not asked him to remove the photo as his personal cover photo, the Mazdaspeed Owners group cover photo, or in his post with the modifications to the wording. Rich @GODspeed7;) I appreciate you tagging me in this thread and making me aware of the situation. |
