Default between a rock and a hard place (please help)

well.. ive been talking about this for a while now, but ill give a brief (ish) over view of my problem here...
i got pulled over about two months ago, and got a ticket for "modified emissions". (keep in mind, it did not say any thing in specific)
i had to get an evaluation by a state(CA) emissions referee.
i had to get this taken care of by 10/29, otherwise i would have a warrant out for my arrest(not a big deal, so i naturally waited until the last minute).
had my referee appointment today (10/28), and i showed up with a stock engine bay with nothing but a boost gauge and a cat-back exhaust.
they got me on the boost gauge being tapped into the wrong Vac-line (my fault, ill take blame for it)
the next reason though, i feel is not my fault.
My car idled for a solid 10 minutes while they inspected a few things, and it began smoking (a common problem with the ms6, even on a stock setup, but more so if a cat/ cats are removed). so they failed me on this also.

I have been to the dealer with this problem before, and they can not get it to replicate, so they refuse to fix it. I figured now that i have gotten a ticket for it, and failed an emissions test because of "smoking from the tailpipes", these documents, along with videos from my digital camera and cell phone would be enough for them to get it fixed. i guess not.

now the part that gives mazda the upper hand...
i got a ticket for "modified emissions", so they automatically see that and refuse service, because they apparently can. only problem is, the ticket was written the wrong way, if it read "car is smoking" my case would look a bit better...

ill be going to court tomorrow morning to get an extension on my due date of the ticket...

as far as what i have come up with for a plan... try to get mazda to fix it (looks like thats not happening)
try a different oil viscosity to stop smoking?

to anyone who reads this, or has any suggestions, thank you. any input is pure gold to me at this point, because my car is technically illegal until this is done (no jail for me please, haha)

The only thing you really can do, is to try to go to another dealer and try to make sure it replicates. Just sit idling in the parking lot til it does it I guess.. Im really not sure what else you can do.
That's a shitty situation though.. Most mazda dealerships suck dick.

my car also smokes when i idle for longer than a few minutes. Take that shit up with the EPA, since mazda doesnt think its an emissions problem. talk to your attorney general and better business bureau

Well you can argue with Mazda and tell them your emissions ticket was because of both, the catback and smoking. I do not know why Mazda doesnt admit to this problem. Here is the easiest fix dane... drain that oil, throw in 10w40 and go back. It wont smoke for that test.

How the hell did you get the emissions ticket to begin with?

the officer just had alot of time on his hands, and when he saw and heard a loud ass blacked out car with tinted windows, he pulled me over and said pop the hood...
once again, the ticket said nothing in specific, just modified emissions, and referee sign off only...
but i am very over my warranty. pay that much money for a car and warranty and they do anything they can to get out of helping me (im also only 18, they dont take me too seriously)... even when i call mazda USA, no help at all...
im going to throw some 10w 40 in there, get it signed off, then slap my fuckin gt 28 on there and call it a day.
thanks for the help...
suggestions could still help me though, as the referee told me he could physically see oil on parts of the turbo, which he said is not directly a fail, but doesnt help me passing at all...

All you have to do is point him to multiple turbo failure/pcv problems with these cars and they will let you slide. Call the state in Sac, main office of BAR ( Bureau of Automotive Repair ) and tell them the situation with these cars.

i do have one question though.. now that my boost gauge is tapped into the wrong line also, wouldnt i still have to tap into a brake booster line or something of that nature to get it cleared off???
and when i got the ticket, the police officer took pictures of my engine bay, which had an intake and a forge BPV that was likely unnoticed. this effect my call to the BAR?

I dont know why they took a picture of it. Pretty lame but i would worry about it. Why did BAR say you couldnt tap your boost gauge from the BPV vac line?

the ref failed me on smoke coming out of the tailpipes, and the vac line.
he very briefly explained it to me, but i didnt comprehend much besides him telling me to get an in line plastic piece to make the line not tee off and if i wanted to keep the gauge, tap into brake booster line.

i wish i could remember what he said now. damn...
it was news to me. i had no idea that would be illegal. any chance prosport had it verified by BAR? the ref said if they did it would be ok. im not expecting them to do that, especially with the limited production of the ms6.

so my plan so far. re-route boost tapping point, and throw some 10w 40 in the thing, and tell mazda

Glad I don't live in california... Just a bunch of tree huggers. I was in traffic and my car started smoking next to a cop. Cop looked at my car and drove off.. I plan on running 5w-40 rotella synthetic to stop the smoking

just went to the store and got some 10w 40 semi synth, just to try it out... figured by the time i get all this stuff figured out (making appointments for ref`s is usually about three weeks out), ill feel justified to buy more oil and swap the turbo out...
